We successfully represented an individual who after having discovered that his former partner was embezzling money, sued his former partner, and obtained a judgment for nearly $900,000 including $300,000 in punitive damages.

As in many unfortunate instances, two individuals (two old friends) entered into an oral partnership agreement, and during the course of over 2 years, the defendant, who happens to be in charge of bookkeeping and finances, tells the Client partner that their business is losing money. After 2 years of hard work, they decide to part ways. However, our client later suspects that his partner was embezzling money.

After we filed suit and commenced litigation, we discovered that our client’s former partner was embezzling substantial sum of money from the company’s sales, which explained why the business was losing money. During the entire course of litigation, the defendant failed to produce numerous documents and records, and he was evading discovery all the way through, and until the date of trial.

However, the defendant having violated various court orders to comply, and produce records which he was ordered to produce, the Court granted our motion to strike the defendant’s answer, and entered judgment against the defendant for nearly $900,000.
